Hearings

Councils have the right to refuse planning permission for a development; lodging a Planning Appeal is needed to contend the refusal of planning permission, and as part of this process the Council will have to set out the clear and unambiguous reasons why an application was refused.

The Hearings process is similar to the Written Representation process, where an independent Planning Inspector is asked to rule on whether to uphold the Council’s decision or overturn it and grant planning permission. In terms of how an appeal is decided, the key difference is that in addition to providing a full written Statement of Case, there is a one-day hearing with an Inspector to explore the issues in more detail, allowing a closer examination of the Council’s decision making.

Hearings allow the Appellant to recover costs against the Council, where it is considered that the Council has been exhibiting unreasonable behaviour in the Appeals process.

The Process Around Hearing Appeals

The Hearing Appeal Process is as follows:

  • Planning Permission Refused by the Council
  • Review Decision and any delegated/Committee Report
  • Prepare and Submit a Planning Appeal with a Full Statement of Case Setting out why planning permission should be granted.
  • Appeal Received and validated by the Inspectorate (the start date)
  • 1 Week from the start date – Council provides the Inspectorate with a copy of its questionnaire
  • 5 weeks from the start date – Council provides its Full Statement of Case
  • 7 weeks from the start date – Appellant can provide commentary on the Council’s Statement of case
  • TBC – Hearing date arranged, attend hearing and subsequent Site Visit with the Inspector Decision subsequently issued.
