What are Local Plan Examinations?

Once a Council has finished consulting on its Local Plan, it must be submitted to the Secretary of State for examination by an Inspector. The overall objective of the Examination is to determine whether the Plan can be found sound and therefore, be adopted by the Council for making decisions on planning applications.

The examination process is complex, the appointed inspector will consider all the evidence provided by the Council to support the Local Plan and allocations made in it. In addition, the Inspector will equally consider all the representations submitted by interested parties and the public. As part of this process, the Plan will be examined to ascertain whether it meets legal tests of soundness, as well as meeting the tests set out in the NPPF. As part of the process, it is inevitable that the Inspector will recommend some changes that are necessary to allow the Plan to be adopted, referred to as Main Modifications.

Monitoring Progress on Examinations

Local Plan Examinations are a key part of the Local Plan process as it represents the independent interrogation of a Plan, by a Planning Inspector. It genuinely offers an opportunity to promote change to a Local Plan.

Understanding the timetable and progress of the Plan through examination is vital. The Inspector will set an agenda of hearings, to examine specific areas of the plan. Monitoring this is essential, to ensure that opportunities are not missed to promote sites.

The examination process involves a great number of people, from the Inspector to Council Officials to interested parties. The key person involved in the administration of the whole process is the Programme Officer, providing a vital liaison point between the Council, the Inspector and the interested parties.

Examinations typically take a minimum of 12 months and can run for longer, depending on the complexity of the Plan.
